# Texas SB 38 and the New TREC Forms: What They Change for Fort Worth Renters in 2026

Texas Senate Bill 38 took effect January 1, 2026, tightening eviction timelines, and TREC form updates followed January 5. Here's what actually changed for renters.

Texas Senate Bill 38 took effect on **January 1, 2026**, and TREC form updates including 15-7 followed on **January 5, 2026**. Both have been quietly reshaping how eviction cases move through Tarrant County’s JP courts ever since.

Here’s the short version for renters: SB 38 tightened eviction timelines. It did not change what an existing filing does to your screening report. If you already have a record, nothing about it got better or worse in January. If you’re at risk of a new one, the clock now runs faster than it used to.

## What SB 38 actually changed

The bill tightened the procedural timeline for eviction suits in Texas justice courts. In practical terms, the gap between a landlord filing and a case reaching resolution compressed.

For a renter, that has one immediate consequence: **the window to respond, negotiate, or move voluntarily is shorter than it was in 2025.** If you get a notice to vacate, the time you have to do something about it before a filing lands on your record is less than you might expect from anyone’s advice given a year ago.

The other consequence is on the screening side. A faster resolution means a filing becomes a resolved record sooner. Whether that resolution is a dismissal or a judgment is the part that matters for your next application, and those two outcomes read completely differently.

## What it did not change

Three things stayed exactly the same, and it’s worth being clear about them because there’s been some confusion:

**Existing records.** If you have a 2023 filing or a 2024 judgment, SB 38 did nothing to it. It sits on your Tarrant County record the way it did in December.

**How screening platforms read a record.** RealPage, SafeRent, and TransUnion SmartMove pull court records and report what they find. The distinction between a filing, a dismissal, and a judgment is the same distinction it always was.

**Property criteria.** Individual management companies set their own thresholds, and those didn’t change because a statute did. Some draw the line at any filing, most draw it at a judgment, and plenty look at age and amount before deciding.

## What changed on the TREC side

The TREC form updates effective January 5, 2026 — including form 15-7 — are brokerage and transaction documents rather than tenant screening rules. They don’t affect whether you get approved.

They do affect the paperwork you’ll see if you work with a licensed agent, and they’re worth mentioning here for one reason: any locator who hasn’t updated their forms is telling you something about how carefully they’re running their business.

## What to do about it

If you have an existing record, the practical steps haven’t changed:

| --- | --- |
| Filing that was dismissed | Pull the record and get the dismissal in writing — it changes conversations |
| Judgment, over two years old | Age helps. Pair with a structured deposit or a guarantor |
| Judgment, recent | Focus on properties whose management reads files manually |
| Balance owed, open | Get a payoff figure and ask what a paid balance does at your target property |
| Balance owed, paid | Get the payoff letter. One page, and it does a lot of work |

## Where this leaves the market

None of this changes the underlying opportunity in Fort Worth right now. Class A rents have posted year-over-year growth for five straight quarters and closed Q1 2026 up 3.2%. Class B just turned positive for the first time since 2023. Class C is still falling, with concessions still widely used across the metro.

That divergence means a renter with a filing who takes the right path in — a structured deposit, a guarantor, or a lease-up community in fill — can land somewhere meaningfully better than where their file suggests. SB 38 didn’t change that. It just moved the clock. Working with a
